Wholesale Terms & Conditions

Minimum Order Quantity (MOQ)

There is a 5 Case MOQ (this does not include orders for any subsidiaries, or other legal entities owned and operated by the Retailer), the Retailer will be notified by email regarding any changes in MOQ. If you are unable to meet the minimum order requirements, you can request bulk order discounts purchased by the case. Terms & Conditions also apply to all bulk orders. Manufacturer's Suggested Retail Price (MSRP) and Minimum Advertised Price (MAP)

The MSRP and the MAP for each product shall be provided by PlantHaul to the Retailer and shall be kept up to date by email. The Retailer may set the retail price as they choose, but the advertised price (online on your own website or your social media account) may not be lower than the manufacturer’s MAP. The final sale price is at the discretion of the retailer.

Online Postings and Listings

You may sell Growth Technology (GT) products on your owned and operated digital properties (including your branded website and social media channels) using the Growth Technology GT brand name, if desired. You may not list or sell any Growth Technology GT range of products on any third-party marketplaces (e.g., Amazon, Walmart, OfferUp, Mercari, eBay, Etsy, TikTok Shop, etc.). This restriction is to maintain brand integrity, quality control, and prevent counterfeiting.

Images & Descriptions

We will provide high resolution photos, upon request, for your website, social media and marketing material. You may use our website descriptions to sell your products. These photos and descriptions cannot be used to advertise non Growth Technology GT Focus Range of products.

Returns/Cancellations

We do not accept returns on wholesale orders for unsold or used items. There is a 25% fee for any canceled orders processed before shipment. Once a tracking number has been provided, orders can no longer be cancelled.

Payment Terms

Payment for orders must be made in full prior to shipment.

Confidentiality

All information provided by PlantHaul, including but not limited to pricing, product details, and marketing materials, is confidential and must not be disclosed to any third parties without prior written consent.

Intellectual Property

All trademarks, logos, and copyrighted materials provided by PlantHaul remain the property of PlantHaul. The Retailer is granted a non-exclusive, revocable license to use these materials solely for the purpose of marketing and selling Growth Technology GT products.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of California. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Orange County, California.

Shipping & Damage

US Orders will be delivered via USPS and UPS. For AK, HI, US Territories, please provide a Freight Forwarder or International Customs Broker.

Pick up availability applies to orders with a total value of $2,500 or more (excluding taxes and any additional fees). A pick-up appointment must be scheduled in advance to ensure timely and efficient service. Customers must present a valid government-issued ID and a copy of the order confirmation email at the time of pick up. Orders must be picked up with 14 days of receiving the notification that the order is ready. Failure to pick up the order within the timeframe may result in the order being cancelled and a restocking fee applied.

If you receive products damaged in shipping, please contact us within 24 hours of delivery for an immediate resolution. Please be sure to capture images of the shipment as it was received and to keep all packaging and products as received.

Severability

If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Termination

PlantHaul reserves the right to refuse service to anyone for any reason at any time. PlantHaul, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future orders, for any reason at any time. Such termination will result in the deactivation or deletion of your Wholesale/Bulk Sale Account and/or pending orders.
